Missouri Killer Appeals Execution Due to Brain Tumor That Could Make It "Painful"

Ernest Lee Johnson, convicted for the brutal murders of three people in 1994, is scheduled to die Tuesday evening at the state prison in Bonne Terre, Missouri.

His lawyers now argue Johnson´s execution would be unbearably painful because of his brain tumor. The lethal injection drugs midzolam and pentobrabital allegedly pose "a substantial and unjustifiable risk of inflicting violent and painful seizures".

A second appeal to the Missouri Supreme Court which claims that the man´s life should be spared because he is mentally disabled was rejected on Monday. Johnson would be the seventh person to be executed in Missouri this year.
