While Montana followed the rest of the US with a recent law lowering the legal BAC for driving from .10 to .08, it refused to outlaw open containers. This means it is legal for drivers to have alcoholic beverages in their vehicles.
Mothers Against Drunk Driving (MADD has given Montana the grade of an F because MADD sees the State as lax against drunk driving. However, Montana increased penalties for drunk driving and requires alcohol tests for drivers who have big accidents.
Rep. Jim Shockley, a State Rep., led the rally against an open container law. He says that the best deterrent against drunk driving is to enforce the laws that already exist. He says: "If they don't like our culture, they should go somewhere else."
