Legal to Drink and Drive in Montana

 

While Montana followed the rest of the US with a recent law lowering the legal BAC for driving from .10 to .08, it refused to outlaw open containers. This means it is legal for drivers to have alcoholic beverages in their vehicles.

Mothers Against Drunk Driving (MADD has given Montana the grade of an F because MADD sees the State as lax against drunk driving. However, Montana increased penalties for drunk driving and requires alcohol tests for drivers who have big accidents.

Rep. Jim Shockley, a State Rep., led the rally against an open container law. He says that the best deterrent against drunk driving is to enforce the laws that already exist. He says: "If they don't like our culture, they should go somewhere else."

Did I miss something? They decreased the allowed blood-alcohol-level, but they're encouraging drink-driving?
I'm pretty sure its legal in Britain to have an open alcohol container in a vehicle, and I wouldn't say that encourages drink-driving. I've given my mates a lift before and they've been drinking in the car and I've never been tempted to join in, A. because I'm driving and need both hands most of the time, and B. because I don't drink and drive cos I'm not a moron.

I guess Montana logic is that if almost everywhere you go takes an hour or two to get there, its alright to have a brewski or two if you stay under the legal limit. I remember when Pennsylvania allowed open containers and my aunt would drive around with a Keystone Light in her drink holder.
Granted, most studies show there is slight intoxication below the legal limits for drinking. I can see having a few drinks at a bar and then letting them wear off but to continue it while driving!!!!

No, no, no...he's got America confused with himself. It's not OUR culture, it's HIS culture. Nobody in my family drives with an open can of (insert favorite alchoholic beverage) next to them and none of the families of my friends do that. If they're going to drink, they do it at a bar or at home, not in a car. Just another classic example of ignorance. He thinks because HE did it, everyone else does it too.

For those of you who cannot read (or at least translate), the law means you can drink while you are driving as long as you are below the legal limit of .08. This is two beers in an hour for an average size man.

Next time I'll try to be clearer.

it wasn't the title that was unclear, it was the fact that its illegal to have an open drinks container in your car! That's what don't make sense! Crazy yanks!

Title clearly shows you are for the open container law.

it is NOT LEGAL to drink and drive in montana.

If one can have an open container in a car, one can drink it. Why else would it be open?
The law says if the driver isn't drunk, this is legal behavior. Where is the bias there?
To many of us its called COMMON SENSE.
The dispute here is when exactly does someone become impaired. Thanks for the insight.
