Police raid home for pot after seeing high electric bills

Carlsbad, California police raided a suburban home after the family's U.S. $250-$300 per month electricity bills led them to suspect that the homeowners were growing marijuana under high-intensity lamps.

Instead, they found often-used washing machines and dryers, three computers always left on, a dishwashing machine running often and three children who forgot to turn off lights when they left a room.

"It's hard to believe a high utility bill would be enough to issue a state warrant," said Dina Dagy, who owns the home. She is demanding a written apology. Police said they have apologized verbally and were following proper procedure.

  It would have.....

had to of been approved by a judge as well, I would assue that this judge would have at least gotten some trouble for this. This is probably a very unique case, where a large consumption of electrical power did not lead to a grow op. However, I think they should have better investigated the situation -ie, high traffic, compare the owners income to his assests on top of the electrical consumption, but not one of about alone.

  welcome

Welcome to the Republican supplied police state. This is nothing compared to what happens that doesn't get reported.

  sigh...

It just goes to show you the drug problem that already exists in the USA.

Next they'll issue subpoenas to people who frequently use the internet, for existing potentiality of hackers...

  re: myrmidon

i think this has nothing to do with the U.S.'s drug problem and everything to do with the U.S.'s eroding-of-constitutional-rights problem.

how did they know about the bill?

I'm wondering, how did the police find out? What is the utility company doing giving out that info? If they are just randomly picking out bills taht exceed a certain amount isn't that just dragnet police tactics? Why don't they just seal off the neghbourhood and bust down everyone's doors? I'm sure that would produce better results.

I thought this is the country of civil liberties...

  this is rediculous

I can not believe this house was raided under false pretense. They figure "why is there bill so high? They MUST be doing something illegal right?" What ever happened to innocent (sp) until proven guilty? that just got thrown out the window. because if they were to have found any marijuana they would have blamed it on the power consumption and now their all of a sudden guilty until proven innocent.

  Any Party

Don't think these things don't go on in a Republican administration. Don't think these things don't go on in a Democrat administation. You'll find that both parties have similar "more arrests" = "more power" people throughout - if you’re willing to do honest, impartial research.

I love my country, but it seems that everyone is throwing in the towel - DEMS AND REPS - when it comes to liberty! In some ways, we have less liberty now than when we under the most powerful (at the time) monarchy, but no is able (and/or willing) to point that on our HDD/ADD/M-O-U-S-E attention span television news audience. And, if by miracle, someone *DID* learn things from a historical perspective, (“HEY YOU!!! – YOU’RE NOT AS FREE AS YOU ONCE WERE!), and that laws we’re being created according to whim (and not our written agreements we signed on for), Joe BrittneySpears would be happy to give his/her/? freedom away for the god of safety (“pay no attention to the guns and cameras”).

Sigh… I've become a Libertarian over the last few years, but just get so discouraged about throwing my vote away every year. People don’t want to be free.

Thanks for the electronic "vent"... :)

  look out

this is what happens when some one says "their should be a law". the next one i catch saying that i should slap them! it is just one more nail in the liberty we have enjoyed in the past. our newbees (young ) will grow up thinking this is ok because they will know no better. i will tell u it is just a next step in our liberty. so LOOK OUT!

  Police/state were RIGHT!!!

When something bad happens Everybody wants to know why the police did not do something to prevent it from happening. BUT when they (the police) try to take a preemptive course of action (with a legitimate lead) and they make an honest mistake now everybody wants to sue. GROW UP! Quit looking for that free hand out! Nobody/nothing is perfect. I would rather a simple mistake like this to happen vs. allowing Cheech and Chong to grow mountains of weed in their house. A formal apology should be given-and that's all.

  Light is much

cheaper energy wise than heat, sound or motion.
I know in the uk to have an electricity bill that size you'd need
£250/£0.10kw/h
2500kilowatt hours
2500/(24*7*4)
300 100watt lightbulbs running non stop.
I'n one house?
Wow, thats a big house

 by: Necralis   04/14/2004 10:58 PM
A BIG law suite should take place

This is totally wrong. The judge and cops down there must be hitting the bowel at lunch time themselves.
High electric bills doesnt justify a warrant for a seach of personal property in itself. I joined the ACLU becuase of crap like this. I suggest you do it to.
I hope that anyone shes in contact with lets her know she should sue them. If not for money for anything else she would want.

"It's hard to believe a high utility bill would be enough to issue a state warrant," said Dina Dagy, who owns the home.

Its not unless the judge is a idiot.
