Did Bush Nominee Help G.W. Escape Jury Duty?

 

There is talk that Alberto Gonzales, Bush's nominee to be Attorney General, played a role in helping Bush avoid jury duty in a 1996 drunk driving case involving a stripper. Had Bush been called, he would have been asked about his DUI in 1976.

On Bush's jury questionnaire, he left it blank on the part asking if he was ever convicted. Gonzales says he went with Bush to court the day Bush was "prepared to serve on a jury." He says the defense lawyer moved to strike Bush from the jury.

The court transcript says what Gonzales says but Travis County Judge David Crain says Gonzales met him beforehand in his chambers. Crain says Gonzales asked that Bush be taken off the jury because as governor he could pardon the defendant.

  I'll explain.  
 The court transcript outlines exactly what Gonzales said happened but it doesn't mention what happened before court proceeded. Should I get it edited?

  As Governor  
 If Bush could pardon the accused, doesn't that kinda make him a member of the court. After all, in the case of Texas vs. John Doe Bush would have been the highest ranking representative of the state of Texas. I do not see anything abnormal about getting the Governor of the state removed from the jury pool of a criminal trial. If it had been a civil trial, the state would have no vested interest in the trial and there would may have been no conflict of interests. I can see a clear reason why the defense wouldn't want the Governor of the state on this jury. It is in the best interests of the state to find the defendant guilty. I can also see a clear reason why the prosecutor wouldn't want to have the Governor of the state on the jury. In what would amount to Governor nullificatoin, despite the fact that the jury may have found the defendant guilty the Governor could overrule them all and pardon the defendant on the spot. No elected official with the priveledge of pardon should sit on a jury in a criminal trial. Likewise no elected official should sit on a jury that may affect their future elections. The elected official could use the case as a campaign commercial later and make the case that they were tough on crime. There is a huge conflict of interest in the case of an elected official being on a criminal jury, and I suspect that a compelling case could be made for removing an elected official from a civil jury as well. There is no scandal here and even less of a story.

 sounds like more media fishing expeditions to make Bush look bad.. I see no real value to this story as anything other than it's a non-story.. people get excused all the time, for all sorts of reasons from juries, this is a case where he should never have even been called to jury duty in the first place..
