74-year-old Yvonne Watts has won what could be a landmark court case after having a hip replacement operation and then asking the NHS to foot the £4,000 bill. The EU judges did not award her the repayment but referred the decision to local courts.
Local courts are to decide whether Yvonne Watt suffered “undue delay” before going to France for her operation. Bedford Primary Care Trust had refused to pay the bill and hence the court case.
Under EU regulations regarding free movements, one healthcare provider should pay the bill if patients are forced to seek elsewhere for their treatment provided there are delays.
