In a case against members of a Mafia family US District Judge Lewis Kaplan has ruled that the federal wiretapping law is sufficiently broad to allow the use of a surveillance method known as the "roving bug."
According to the opinion issued by the judge the technique allows a cell phone to be activated remotely and used as a listening device. The eavesdropping method "functioned whether the phone was powered on or off".
Specifics are unclear but it is most likely the technique involves remotely installing software on the target phone. This method could only be used by a law enforcement officer. Private investigators could not legally use it under any circumstance.

The FBI can listen in on just about anybody's cell phone conversation. They used to not be able to legally do it, but since the patriot act and a few other laws they can pretty much do as they please.

You know your calls are able to be monitored when using the phone. But with the phone in 'standby' or off is a major abuse.
Dude, first of all, you don't talk about anything over the fone, except maybe "I won't be home for supper mom, put it in the fridge..." He meant take it out while in person talking. This is why I'm glad I'm in Canada. They can do it, but need sufficient grounds to use the evidence in court. They have been able to do this for a while. now we've got always-on wireless interenet, webcams, wireless mp3 players soon, mobile phones can be triangularly traced if they're switched on (most bought in the last 5 or so year anyway), mobile email devices and information storage devices.

The government can do whatever they want. The patriot and privacy act? lol @ that In reality, whether they have permission or not, the government can do what they want, and thats how it is. A lot of people think that "America would never do that because of the acts instated"...Right....In the end, this isn't a surprising story at all. I mean look at cell phones for example. All of them that come out HAVE to have some sort of GPS locator on it. Of course you have the option to turn it off or on. "On" means that anyone can locate you. "off" means that only "emergency" services such as 911 can locate you. Its a good idea in the context that in case a tragedy or accident happens, technology will help out to get people such as the paramedics over to your house. At the same time, the government can use that if they want to. But it all comes down if I have anything to hide. I don't, so no big deal.
It would be simple to install a slide-switch or dip-switch or any other type of switch, all it would have to do is cut the mic when in off-position then when you want to talk slide it back to on. Problem is making it look good. You know how vain people are about their phones they wouldn’t want anything gaudy coming out of it. It would be harder to install something that looked good, especially on those tiny flip fones.
Provided the "technique" is correct... Aside from the newer generation of cell phones, a lot of cell phones don't have the memory to hold and install a program that would intercept and enable the phone's microphone and transfer the recorded audio upstream... Not to mention, every firmware/hardware manufacturer would have to have built something in to allow this capability... So, I would venture to say this "technique" would only work on the newer generation of phones. Probably those running Windows CE/Windows Mobile of some sort...
Moving on, it would be ridiculous for them to open up such a large possibility for abuse. An ability for someone to "remotely install" software is insane... Even if you managed to secure it from potential outside use... all it would take is a pissed off phone employee to install something nasty across a lot of phones...
I just can't see this working on every phone from every manufacturer on every network.

Carnivore was a gigantic waste of money. It had the functionality of the program "SubSeven" of it's time... and yet cost millions upon millions of dollars... and I'm not even sure it really ever made it into full production...
Malicious hackers have followed suit. A report last year said Spanish authorities had detained a man who write a Trojan horse that secretly activated a computer's video camera and forwarded him the recordings.
One guy above said he doubts its possible because no cell phone could store such a program as it would be quite sizeable.
Well two things. 1) Alot of new models are coming out with quite a bit of storage capability. Theres a samsung or two with 80mb internal memory, plus the memory stick stuff. 2) There are phones for sale from certain sites/stores, with either this exact same feature(as mentioned in the article) or something similar. Basically, you CAN remotely access/turn on a mobile phone, and listen in on whats going on.
I highly doubt that if this stuff is available to the public, that a federal law enforcement agency wouldn't be able to do the same, or be more capable.
And some of you are so scared of all this technology I can almost imagine you gathering up all your electronic equipment and starting a bon-fire with it.
Its kind of funny though. People are complaining about the government spying on them(even though this is a case of them bugging a bunch of criminals), but if nothing was done against the mafia, people would then be complaining the government doesn't do enough.
