RIAA Wins Court Case Against File Sharer - Awarded $ 220,000

 

Duluth, Minn: The RIAA has been awarded $ 220,000 against a file sharer. Jammie Thomas was accused by the recording industry of sharing 24 songs on the Kazaa file sharing network and was ordered to pay $9,250 for each of the songs.

The RIAA alleged she shared some 1,702 songs in total. Thomas denied even having an account on Kazaa. Record companies have filed lawsuits against 26,000 people since 2003 for sharing files.

The companies' lead attorney Richard Gabriel said it would send a message to other illegal downloaders. "I only ask that you consider that the need for deterrence here is great" .

BTW, NOBODY has a kazaa account... kazaa doesn't even have account... they have handles, and you can change that a million time a day if you want.

also 1702 songs is nothing... once upon a time i had over 25,000 songs... RIAA wants to whine and bitch about the money they are losing. tough shit. make a product worth buy, technology has long since surpassed the boundries of the RIAA... ANYONE now can burn a cd, ANYONE can download.

someone should just beat thew living shit of these RIAA goons in the middle of court and say "there, now you can sue me", then refuse to ever pay taxes so long as the goverment supports these sue-happy goons.

RIAA couldnt sue were I live since the amount they sue for is considered a way for them to supress any mean their victim has to respond/counter sue/ what ever, to shut them up good. And the case would be dismissed.

The lawyer for this guy didn't know enough to get this thrown out. The defense focused on the fact that he didn't do it. The defense should have focused on the fact that peer networks don't upload complete files. A file is just a number, even if it is an astronomical number. How can someone own a number? Well you can't own a number. All this person did was share a number, with a bunch of other people who had a number, and then the reciever added them together. I'd like to see the RIA beat mathmatics in court. They need to get someone familure with the technical aspect of file sharing to debate the RIAA in open court. Hopefully with a Judge that isn't some old guy who has no understanding of the mechanics of data. Basically peer networks share a mathmatical formula, not a file. 00010101001010 + 101001010101001010101 + 110010010010101001111000 etc. The RIAA doesn't own math. I've actually seen some really smart IT people convert files into mathmatical expressions to compress them. Then just send the mathmatical expression rather then a binary representation of the entire file(out of boredom).

The court says the RIAA doesn't need to prove the files were uploaded, it was a crime to make them available.

How does the court know the files weren't all spoof files like the ones Media Defender puts on the network? That would be my next argument.

"Well judge, if they don't need and don't have proof the file was uploaded, I put forth to this court that all of the files were 0kb fakes and no copyrighted material was made available" Shaburn.

The judge ruled you don't have show a file sharing program was on the machine and you don't have to show the person actually sat at the keyboard and shared the files.
