It's Still Legal for Teens to Have Sex in Germany

Germany's coalition government was considering legislation where it would have been illegal if someone between 14-17 years old used money or a reward to get someone else in that age group to engage in sexual contact.

Critics stated the definition of something for value was so broad that teens could be arrested for having sex after inviting someone over for a movie. Purchasing sex from minors will be illegal under the new legislation.

It is illegal for someone over 18 to have sex with someone under 18 in Germany. The new law will have bigger penalties for adults who possess child pornography versus teen porn. But, teens will not be punished for having nude pictures of other teens

Thanks to federal legislation, it is illegal for teens to have sex with other teens in the US and having nude pics of one's girlfriend would be considered child porn with a prosecutor ready to charge him or her as an adult.

  Happened to my brother

His school confiscated his phone one day and found an obscure picture of his girlfriend lifting her shirt. After the officer stared at it for long enough to make anyone want to hit him, he claimed he was going to charge him with possession of child porn. The irony was, his girlfriend was older than him!

It gets worse -- I remember a case from a few years back where a mother was charged with promoting sexual abuse of a minor. The state charged that because she was aware that her underage son and his underage girlfriend were in a sexual relationship, she was aiding and abetting them as they, apparently, "abused" one another.

I don't remember how the case turned out -- that would be interesting to know.

  To the first

In addition to 18 years old the sex is natural i think but for the teenagers without somebody else knowledge is recommended the one.

Wow, did not expect that. Course that proly only applies to both parties being under 18, so no big deal there. As long as they don't adopt the asinine laws that the USA has.

  I don't get it

I don't understand the logic behind some countries/states having a law that lets people of a certain age (say for example 16-17) have sex *only* with people in the same age group, and then anyone over that being allowed to have sex with others who are also over.

That means that if there is a couple where one is 16 and the other is 17 it would be legal for them to have sex for a year, then illegal for a year, then legal again!! (Which would have been the case for me and my ex if I lived somewhere with this law.) What changed in that time?

Surely if the law decides that people are physically and mentally old enough to have sex then it shouldn't matter about the age of the other party. I just don't get it!

  Sex laws

Sex laws are a big huge mistake, and an infringement on human rights. Now about children, parents have to take responsibility for what their children are doing.

If it's abuse, then that parent has failed to protect his child.

Seems like an obvious question but if under 18 gf/bf each have nude photos of each other, and you try them as adults aren't you admitting they are old enough to make those decisions?

The whole point in those laws is to prevent older people from taking advantage of teenagers. It would seem silly to prosecute a 15-year-old boy for having sex with his girlfriend of the same age, they are at an age where they are starting to experiment and neither is taking advantage of the other's inexperience and vulnerability. It's a very different scenario to say, a 40-year-old man having sex with a teenager, you could say that he was taking advantage of the fact that they are young and inexperienced, whereas 2 teenagers are more like equals.

The German law does sound pretty stupid, if they want someone to be allowed to have sex at 14, but not with adults, they should say that under the age of 18, you can only have sex with someone within 2 years of your own age, or something like that. So a couple who were 14 and 15 would be able to have sex legally, but an 18-year-old couldn't sleep with a 14-year-old. The 18-year-old would still be able to sleep with people aged 16 or over though, that would make far more sense as it wouldn't jump from being legal, to illegal once the older kid reached their 18th birthday.

  A thought...

Two teenagers have sex when they are both 14-15 years of age. After this experience, the boy goes through changes. Perhaps it is a physical accident, or he starts showing anti-social behavior, or he becomes a recluse, or any other thing that may damage his reputation, killing off any social life he may have. He remains this way through his 20's, his 30's, his 40's. And the only sexual experience that he remembers (and he remembers it well) was this moment with this girl. Being a man in his 40's, does this make him a pervert?
