14 y.o. Girl Charged With Rape Because 13 y.o. Boy Forced Her to Have Sex

A 14 year old female has told the media that she is being charged with rape for having sex with a 13 year old male. She says she was charged after she told a school counselor that the boy forced her to have sex.

The girl told a school counselor a month after the event and he called the police. In Kansas, where this allegedly took place, it is illegal for someone 14 or older to have sex with a 13 year old.

Defense attorney Sean Shores is so outraged that he's defending the girl for free. The girl said she went to the counselor since: "I wanted help because it was my first time and I was scared."

  This is outrageous.
She's a child who was raped, for ****'s sake. And to think, I'm moving to the great state of Kansas shortly...fantastic.

  Not In Kansas Anymore!!
Where have I heard about this scenario before? Oh yeah ...... extremist Muslims following their own twisted translation of a religious writing; which, I thought, the American legal system abhored - guess I was wrong.

How is this any different from an adult woman being raped by a 17yr old? Would SHE also be charged with rape since he is a minor?

Only other thing I can say is ........ WTF !!!

There has to be more to it than this
Gotta be, what insane D.A. would even prosecute something like this? What police officer would arrest?

  Legal insufficiency
The "boy" probably didn't know better but could be locked up for years, the "girl" is being victimized by meaningless blanketed rules.

Sex laws don't work.

"I wanted help because it was my first time and I was scared."

Is that how most rape victims refer to their rape? As their 'first time'?

What I want to know is
To what address can we send outraged emails?
  by: Eidron   06/26/2008 10:44 AM
hopefully people in the area are already emailing about it, and ya that's definitely the right attitude.

As for this law, 14? o.o eesh.

Why can't people just understand that the little enjoyment they'll get out of forcing others into doing what they want is far outweighed by the negative that comes from it?! (FOR BOTH PARTIES !@!@ BAH.)

  @ Discarded Vet
This is sad.. I wonder if the court of law is really that stupid. I admit that I have not read the details of the story but I’m sure there more to it ..
Discarded Vet stop blaming religions and if you think you are right..

Please name me one religion which it is lawful for a thing like this to occur. Stop commenting vague stuff, and blaming religions if one guy claims to be a muslim and does something bad it does not mean that there scriptures say so and same goes for all the other religions.
  by: 2?   06/26/2008 11:09 AM
I would change that thought, the law seems to be demented, and that is being polite about it.

This is seriously back ward, someone needs to intervene here.
  by: captainJane     06/26/2008 11:44 AM
  @ 2?
You read the word "Muslim" and NOTHING ELSE didn't you. Go back and re-read the whole damn paragraph.

You attempt at a flame has failed miserably!
by: Discarded Vet   06/26/2008 11:47 AM
Well scriptures apart, every religion has certain hardwired cultural elements to it (i e there's no country music in the Bible, America isn't even mentioned). Even if the Quran does require muslims to respect women, most muslim communities interpret that in a rather arbitrary way, I think that's what DV meant by 'twisted translation'. A girl accusing someone of rape in such a community would be a social outcast, which in turn would lead to her being fair game for every male. Even if the same society theoretically has death penalty for rapists. So the question is not whether it's lawful in a given religion, but rather does that religions tradition allow for a thing like that to occur.
And its not just islam, groups like the amish p.e. foster sexual abuse by denying it ever occurs, and from what I hear even in our society women who talk about being raped are stigmatised. Yay ranting

think they were curious about each other only, nothing serious would have been trouble because they are children yet.

I know a lot of you guys are upset, as well as I, but laws are not designed for case by case systems. That way equality is best served in enforcing the law.

It is then up to the judge to allow this case to go forward, have it dismissed, etc.

Shouldn't the older of the two have to be at least 4 years older?
  by: Svengali   06/26/2008 10:22 PM
you say that little enjoyment will be derived from doing something against someone's will, but you know, that type of person enjoys it. They enjoy causing fear and pain in others. So regular s*x would not really give them that thrill, because they're sociopaths.
  by: gryphon50a   06/26/2008 10:25 PM
  Why can't the law
accuse the one responsible? If your're 13 and are large and stronger than a 14 year old and overpower them (at least this might be the case) how do you blame the older person?

  Hurry up 2012!
If mass extinctions are going to happen in 2012 as some believe, I sure hope it takes some of these idiots out of the equation when it does! Stupid people are taking over the world. If that was my daughter, they'd play hell trying to get past me to have her even make a court appearance for such absurdity.

No Muslims only hate our freedom, and since they have oil, we will give ourselves the liberty of kicking their asses and take away their freedom in the name of liberation to have other nations join us, and while there we will rape our own service women and who are there to be raped anyways and we will blame it on Testosterone! or better one

Wait a minute why am I ranting about Afghanistan! This happened right here in our own backyard...
Bring the GUNS.

@ above comments: It has nothing to do with Islam; the discussion as such should stop there.

Now, back to the issue: I haven't found any more info on this--I'd like to find out what's going on. I want to lend whatever support to the girl I can.

  hear hear
If there's one topic that shouldn't be allowed to evolve into a discussion of George Bush and the end of the world, its this kind.

Most people in Kansas have their heads screwed on backwards so tightly that you couldn't fix them with...I'll stop there before I get anxious.

When you can't find any more info on a topic its because they're ashamed of themselves.

"Shouldn't the older of the two have to be at least 4 years older?"

Regardless of age, if the 13yo "forced" her to have sex, it's forcible rape, which I've never seen anyone argue to be OK.

Statutory rape, which is what the girl is being charged under, can be total bullship under many circumstances, this one being a classic example.

Iagine how hard it must have been for her to talk
about this and what does she get in return? Being the guilty criminal.

Religins can be more biased towards men, but it is not ie to religion alone; this is due to deeply ingrained cultural influences. I won't go into gender gap and sexism b i do hope this girl gets a fair treatment.
