According to Flagler County authorities, Richard Phinney received more than a bad takeout order from Goomba's Pizzeria located in Plam Coast, Florida -- he also received a beating from Joseph Milano, who is also the restaurant’s owner.
The altercation took place when Phinney went back to the pizzeria seeking a refund for an improperly prepared calzone. According to a police report, security footage revealed that Joseph Milano then struck Richard Phinney in the head with a pistol.
After pistol-whipping his customer, Milano proceeded to jump over the counter to continue his assault, attacking both Phinney and his roommate. Milano was charged with aggravated assault and battery with a deadly weapon and has been released on bail.
