Letter Stamped "Deceased" - Mother Sues

 

Last month Joan Najbar from Duluth, Minnesota, who is the mother of a soldier serving in Iraq, filed a lawsuit in US District Court in Minneapolis for her emotional distress. She claims the Postal Service is guilty of negligence.

Najbar sent a letter to her son in Sepember 2006, which was sent back after some time by the Postal Service with a stamp on it as "deceased". The Postal Sevice found no negligence on its investigation in 2006.

They managed to learn from the Red Cross that the soldier is alive.

How about an apology, that would probably help. Everyone is just after the $$$. So many lawsuits, they made a mistake, they happen, no one is perfect

I second the agreement.

I can´t imagine the pain and anguish she felt, but getting a few bucks won´t help.

Your son is alive, that should be all that you need.

They should have to pay for any counseling this woman wants (as long as it is related), but not more than that. Except her court fees, of course.

An apology would just seem to be common sense here, not to mention decency.

´Deceased´? seriously? What business does the postal service have of informing mail senders that some intended recipient is dead? How about ´Undeliverable´ and leave it at that... sheesh...

i thought undeliverable mail was marked as ´deceased´ after the a certain time period was elapsed. I thought thats why its called the ´dead letter office´ .

The USPS has 12 or so stamps to choose from when a letter is deemed undeliverable. I do not see some overworked (although frankly overpaid) schmuck picking up the wrong stamp being justification for a lawsuit. I hope she is held liable for court costs.
